These Terms and Conditions constitute an Agreement between Cossy Pte Ltd and the End User. By using this site (the Site), you (or User) agree to the terms and conditions that we (Cossy.com.sg or Cossy Pte Ltd) have provided. It is acknowledged that if there are interruptions in the internet service or events that are beyond the control of Cossy Pte Ltd, and Cossy shall not be responsible for any data lost while transmitting information on the Internet. Cossy reserves the right to change or discontinue any aspect or feature of the services without prior notification.

End User Conduct

Cossy aims to make the use of our site a positive experience for all of our users. All End Users shall comply with these Terms and Conditions and restrict any and all activity in connection with the use of this Site and the Microsites to that which involves lawful purposes only. End User shall only post or transmit through this Site any lawful material which does not violate or infringe or induces to violate or infringe in any way upon the relevant laws and/or the rights of others, or which, without Cossy's express prior, written approval, containing any advertising or any solicitation with respect to products or services. Any End User shall refrain from restricting any other End User from using or enjoying this Site and/or any of the Microsites or using this Site or any of the Microsites to advertise or perform any commercial, religious, political or non-commercial solicitation, including, but not limited to, the solicitation of users of this Site and/or the Microsites to become users of other on- or offline services.

Any conduct by a User that in Cossy's exclusive discretion restricts or inhibits any other User from using or enjoying this Site is strictly prohibited. User agrees not to attempt to reverse engineer or jeopardize the correct functioning of the site, or otherwise attempt to derive the source code of the software (including the tools, methods, processes, and infrastructure) that enables or underlies the Site. User must not upload or transmit any form of virus, worm, Trojanhorse, or other malicious code.

You acknowledge and agree that Cossy Pte Ltd may preserve information and content and may also disclose information and content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:

*enforce these Terms of Use
*respond to claims that any information or content violates the rights of third-parties
*protect the rights, property, or personal safety of Cossy.com.sg, its users or the public.

The foregoing provisions of this section apply equally to and are for the benefit of Cossy Pte Ltd, its subsidiaries, affiliates and/or its third party content providers and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf.

Intellectual Property

All intellectual property on or in this Site, including the Microsites, is the exclusive property of Cossy or used with express permission of the owner of the intellectual property. Any infringement of the said intellectual property rights shall be strictly prohibited. In case of any violation of the intellectual property rights, Cossy expressly reserves the right to take legal action.

End User acknowledges that no ownership rights are being transferred by downloading copyrighted material. Trademarks that are located within or on the Site or a Web site otherwise owned or operated in conjunction with Cossy shall not be deemed to be in the public domain but rather the exclusive property of Cossy, unless such site is under license from the Trademark owner thereof in which case such license is for the exclusive benefit and use of Cossy, unless otherwise stated.

End User may only upload, post or otherwise make available on this Site such intellectual property which he/she/it is expressly permitted to use by the owner of the intellectual property right. It is the sole liability of End User not to infringe any intellectual property rights or any other infringement resulting from such a submission. End User warrants that the owner of such submitted material has expressly granted Cossy the royalty-free, permanent, irrevocable, non-exclusive right and license to use, replicate, change, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology for the full term of any copyright that may exist in such material. For personal use, any other end user is permitted by End User to access, view, store or reproduce the material. Cossy is hereby granted the right to edit, copy, publish and distribute any material made available on this Site by End User.

The above holds valid for and is for the benefit of Cossy, its subsidiaries, affiliates and its third party content providers and licensors. Each shall have the right to assert and enforce such provisions directly or on its own behalf.

End User hereby agrees to grant to Cossy a royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform, and display all communications posted on or through this Site, alone or as part of other works in any form, media, or technology, and to sublicense such rights through multiple tiers of sub-licensees.

Disclaimer of Warranty; Limitation of Liability

End User expressly agrees to and acknowledges that using this Site is at End User's sole risk. Cossy, its affiliates, the respective employees, agents, third party content providers and/or licensors do not warrant any results that may be obtained from using this Site nor the accuracy, reliability and/or content of any information, service or merchandise provided through this Site or the Microsites. Cossy makes this site and the Microsites available on an ?as is? basis without any warranties of any kind to the extent permitted by the applicable law. Cossy disclaims the liability for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, for any cause of action. End User expressly agrees and acknowledges that Cossy is not liable for any conduct of other end user or third parties. Such risk lies with End User. Cossy or any of its affiliate or employee(s) or person(s) or legal entity(ies) involved in the creation, production or distribution of this Site and/or its contents shall not be liable for any damages arising out of the use or inability to use the Site and/or the Microsites. Cossy disclaims any liability for any content that any person or entity may post on this Site and/or any Microsite. Cossy expressly reserves the right to remove and/or prohibit any content posted or uploaded on our Site at our discretion without prior notice. In order to enforce the above, Cossy shall have the right, but not the obligation, to monitor any content of the Site.

Indemnification

End User agrees and acknowledges to defend, indemnify and hold harmless Cossy, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of this Site and/or the Microsites by End User.

Termination

Cossy reserves the right to terminate this Agreement at any time at its sole discretion.

Trademarks

Cossy,Cossysg, Cossy.sg are trademarks of Cossy Pte Ltd. All rights in respect of this trademark are hereby expressly reserved. All other trademarks appearing on the Site of Cossy are the property of their respective owners, unless otherwise indicated.

Third Party Content

Any third party who expresses or makes available opinions, advice, statements, services, offers, or other information or content are those of the respective author(s) and/or distributor(s) and not of Cossy. Cossy merely distributes (and does not publish) such content supplied by third parties and End Users. Accordingly, Cossy has no editorial control. Neither Cossy nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose.

Cossy neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made on Cossy by anyone other than authorized Cossy employee while acting in official capacities. Under no circumstances will Cossy be liable for any loss or damage caused by an end user's reliance on information obtained through Cossy. It is the responsibility of End User to evaluate the accuracy, completeness, or usefulness of any information, opinion, advice, etc., or other content available through Cossy.

Cossy contains links to third party Web sites maintained by other content providers. These links are provided solely as a convenience to you and not as an endorsement by Cossy of the contents on such third-party sites and Cossy hereby expressly disclaims any representations regarding the content or accuracy of materials on such third-party Web sites. If End User decides to access linked third-party Web sites, End User does so at its own risk. Unless you have executed a written agreement with Cossy expressly permitting you to do so, you may not provide a hyperlink to the Site from any other website. Cossy reserves the right to revoke its consent to any link at any time in its sole discretion.

Miscellaneous

These terms and conditions and this Agreement and any operating rules for Cossy established by Cossy constitute the entire agreement of the parties with respect to the subject matter hereof. If any provision of this Agreement is held invalid by a court of competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions contained in this Agreement and the remaining portions of this Agreement shall continue in full force and effect.

Cossy Pte Ltd is a company duly established under the laws of Singapore. This Agreement (and these terms and conditions) shall be governed by, and construed in accordance with, the laws of Singapore. All legal issues arising out of or in connection with the use of the Site as well as the Microsites, including any question regarding its existence, validity or termination, shall be referred to and finally and resolved by the courts in Singapore and shall be exclusively governed by the laws of Singapore.

By pressing the Buy button the End User places an Order which constitutes an offer to Cossy to purchase the vouchers and/or products the End User selected on the terms and conditions stated below. It is in the sole discretion of Cossy to accept this offer. For more information, please view the Privacy Policy. End User is required to create an account in order to purchase any product.

Once the purchase is complete and the minimum purchase requirement is met, Cossy will send an email to the End User with a link to a digital, printable voucher.

The purchased voucher is redeemable for goods or services by the seller of such goods and services (Business). The Business only is the seller of the goods and services and is solely responsible for redeeming any voucher you purchase from Cossy. Cossy sells a voucher that can be redeemed in connection with your purchase of the goods or services from Business.
All vouchers printed from the Cossy website or any website associated with Cossy (Vouchers) are promotional vouchers that are offered to customers below their face value and shall be subject to the terms and conditions of Cossy and the participating Restaurant or Business. The Business is the seller of the goods or services which you are purchasing.

The expiration date on the voucher dictates the last date that you can use your voucher at Business or restaurant for the promotional offer which is stated on the voucher.

The issuing of credit is at the sole discretion of the Business unless otherwise required by law. Neither the seller nor the Business is responsible for lost or stolen certificate or certificate's reference number. Certificate cannot be combined with any other gift certificates, third party certificates, coupons, or promotions, unless otherwise specified by Business. Reproduction, sale or trade of this certificate is prohibited unless done so in compliance with the law. Any attempted redemption not consistent with these terms and conditions will render the certificate null and void.

The Cossy offer (including, but not limited to, any discounts) expires on the date specified on the Cossy voucher, except that the Business in its sole discretion may continue to redeem the unused cash amount you paid for the Cossy credit (which is usually less than the original face value of the Cossy credit).

If you redeem the Cossy for less than its face value, you will not be entitled to a credit, cash or a new Cossy equal to the difference between the face value and the amount you redeemed, unless otherwise required by law. You will only be entitled to a continuing redemption value as noted above if the amount that you paid for the Cossy exceeds the amount you redeemed. You will not have any redemption value either because the amount you redeemed is more than what you paid for the Cossy.

Cancellation & Refund Policy

Vouchers may only be refunded within 5 business days after the deal closes. Please contact the Cossy team that will decide about the issue at its discretion on a case by case basis. Account Credit will be issued instead of cash or products and it can be used to purchase other deals in the future.
